Terms and Conditions of Use

Introduction

These terms and conditions (the "Terms") govern your access to and use of ("Kazoz”); an online store and website for downloading and viewing content including mobile applications, videos, audio, images, music files, Islamic files, themes, text, information, data, software, and/or any other online products or services (the “Services”), developed and operated by Beecell International Limited (“Beecell” or “We”).This service offered by Beecell allows you as a user (“User or “You”) to download, view, access the Content, or subscribe to Kazoz different sections.

These Terms constitute a binding legal agreement between you and Beecell and governs our relationship with You. The accessing and continued use of Kazoz, and commencement of steps to create an account (as defined hereunder), is considered an acceptance by You of all such Terms. If at any time, you do not accept the Terms, you should immediately stop using Kazoz and/or its services. Beecell has the right to refuse, suspend and or cease the provision of the services to any User that refuses to abide by the Terms, and\ or abuses the rights of use and\or access of Kazoz.

These terms and conditions are effective immediately upon the access and use of Kazoz.

Section 1: CHANGES TO THESE TERMS

Beecell may change the Terms at any time. You are responsible for regularly reviewing these terms and conditions for any changes. Such modifications, amendments or deletions shall be effective immediately upon posting them on Kazoz. Continued use of Kazoz following any such changes will be interpreted as acceptance to such changes.

Section 2: USING OUR SERVICES

You may use Kazoz and the Services provided through Kazoz in accordance with the Terms and any applicable laws. You are not allowed to misuse our services.

You may discontinue your use of any service at any time.

We are constantly changing and improving our Services. We may add or remove functionalities or features of the Services at any time, and we may suspend or stop a Service altogether. Beecell may also in its sole discretion and at any time modify or discontinue providing, temporarily or permanently, Kazoz or any Services, or sites, available on or accessible through Kazoz, or any parts of the foregoing, with or without notice.

The User agrees that Beecell will not be liable to the User or any third party for any such modification or termination of Kazoz or any Services, or sites, available on or accessible through Kazoz, or removal or deletion of the Services or any links to other sites within Kazoz.

SECTION 3: ACCOUNT, PASSWORD AND SECURITY

As a User you must create an account on Kazoz and must verify such account. You are responsible for maintaining the confidentiality of your user name and password, and is fully responsible for all activities that occur under your account. You agree to (i) immediately notify us of any unauthorized use of your account or any other breach of security and (ii) ensure that You fully exit from your account at the end of each session. We will not be liable to You or any third party for any loss or damage arising from or related to the unauthorized use of Your account as You are solely responsible for all activities and actions that occur under Your account. If You violate the terms you may be prevented from accessing Kazoz and Your account.

Resetting your Account: we hold no responsibility regarding any action you make through Your device that might result in resetting your Account on The Store and therefore losing any saved information or any other details (for example by enabling the “clearing your application cash”) on Your device. 

SECTION 4: ELIGIBILITY TO USE

By using Kazoz, You represent and warrant that You are eligible to our Services as set forth in these Terms and that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) You are eighteen (18) years of age or older; and (d) your use of the Services does not violate any applicable law or regulation. Your account may be deleted without warning if we believe that you have violated any of the mentioned above conditions.

SECTION 5: THE USER RESTRICTIONS ON THE STORE USAGE

As a User, you will be restricted to use Kazoz in the following manner: To infringe any copyright registered or not registered, or any other intellectual property right, registerable or un-registrable; to infringe any patent or trademark; to infringe any right of publicity, right of privacy or other proprietary rights of any third party.

SECTION 6: CHARGES AND PAYMENT

The User will only be able to access the Service if the payment was successful or User is actively subscribed to the Service, otherwise, the User will not be able to view the Service and without any responsibility whatsoever on Beecell.

The Services charges are fixed by Beecell according to the mobile network operator’s charges for each country, and such charges are changeable by Beecell without giving any notice to the User.

The subscription payment will be charged and deducted upon its due date as long as the User has not cancelled the subscription through his account.

SECTION 7: WARRANTIES; DISCLAIMERS

DISCLAIMER: BEECELL MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OR RESULTS OF THE SERVICES OR INFORMATION CONTAINED ON THE STORE FOR ANY PURPOSE. ALL SUCH SERVICES AND INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. BEECELL DOES NOT WARRANT THAT THE INFORMATION WILL BE UNINTERRUPTED OR FREE OF ERROR, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE, ARE FREE OF VIRUSES OR OTHER ADVERSE COMPONENTS. NEITHER BEECELL NOR THE STORE PROVIDE ANY TYPE OF GUARANTEE OR WARRANT THAT THE CONTENTS ON THE STORE ARE CURRENT, ACCURATE, RELIABLE, COMPLETE OR ERROR FREE. THE CONTENT PROVIDER EXPRESSLY AGREE THAT THE ENTIRE RISK AS TO THE ACCURACY OR COMPLETENESS OF THE CONTENT IS ASSUMED SOLELY BY YOU.

SECTION 8: LIMITATION OF LIABILITY

Under no circumstances shall Beecell through Kazoz its officers, directors, shareholders, agents be liable for any direct, indirect, incidental, punitive, special or consequential losses or damages as a result of the using The Store. This includes without limitation, attorneys' fees, whether in an action of contract, negligence or other tortuous action, that result from the use of, or the inability to use, any Services available on Kazoz, even if Beecell has been advised of such damages. Beecell shall not be liable in any manner of any content and/or Services uploaded on Kazoz. As such, Beecell shall not be liable for the use or the inability to use Kazoz or Services available thereon. If you are dissatisfied with any Service, information, or with any of the Terms, your exclusive and only remedy is to discontinue using Kazoz.

SECTION 9: THIRD PARTIES AND OTHER USERS

Services and/or content from other third parties is made available to you on Kazoz. Beecell does not control such content, you understand and agree that Beecell is not responsible for any such content, including advertising and information about third party products or services. Because Beecell does not have control over such content, Beecell makes no guarantees about the accuracy, currency, suitability, or quality of such content and/or service, and Beecell assumes no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content and/or service made available by content providers, advertisers, and third parties.

You understand and agree that the availability of links to other websites or locations on Kazoz is for your convenience and does not signify our endorsement of such other websites or locations or their content.

SECTION 10: INTELLECTUAL PROPERTY

You acknowledge and agree that the Service, any necessary software and/or information used in connection with the Service and any description available on the Service contain proprietary and confidential information that is protected by applicable intellectual property and other laws.

Beecell’s name, the logo and any other product and Service marks are the exclusive trademarks of, and are owned by, Beecell, and you may not use or display such trademarks in any manner without the Beecell’s prior written consent. Any third-party trademarks or service marks displayed on the Service are the property of their respective owners.

SECTION 11: CONFIDENTIAL INFORMATION

Should any User respond by submitting information, feedback, data, questions, comments, suggestions, techniques, concepts, essays, know-how, ideas or personal identifiable information such as name, address, telephone number, email address, or other information, such information shall be deemed to be non-confidential. All submissions, information and correspondence as stated above, shall become the property of Beecell, and Beecell shall have no obligation of any kind with respect to such information. You agree that you shall have no recourse against Beecell for any alleged or actual infringement or misappropriation of any proprietary right in your communications through Kazoz.

SECTION 12: SEVERABILITY

If any term or condition or provision of the Terms is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms shall continue in effect.

SECTION 13: TERM AND TERMINATION

You agree that the Company may, in its sole discretion, suspend or terminate your account and/or access to the Service for any reason or no reason, with or without prior notice. Any licenses contained in the Terms will terminate automatically without notice if you fail to comply with any provision of these Terms.

SECTION 14: GOVERNING LAW AND JURISDICTION

These Terms will be governed and construed in accordance with the laws of the Dubai - UAE. All disputes arising out of or relating to these Terms or the use of the Application shall be settled amicably. Failing such an amicable settlement, all disputes shall be finally settled by the courts of Dubai-UAE.

No part of these Terms may be copied, duplicated, retransmitted, reposted, in whole or in part, or otherwise used without the express written approval of BeeCell.
